“VOTE IMPOWERING HANNAH AND PELATIAH WARE, EXECUTORS, TO SELL REAL ESTATE, AND MAKING PROVISION IN REGARD TO THE PROCEEDS.
A PETITION of Hannah Ware, Peletiah Ware, Wareham Warner, Hannah Warner, John Crage and Hayward Smith, Setting forth, That your Petitioners Viz Pelatiah Ware, Wareham Warner and Hannah Warner, are Children and heirs of Beriah Ware late of Wrentham deceased, and of full Age, That your other Petitioners Viz Hannah Ware, John Crage, and Haywood Smith are Guardians of Beriah Ware, Margaret Ware, Unity Ware Children, and Abigail Smith a Grand child, and all heirs to the Estate of the said Beriah Ware deceased. That the said deceased by his last Will, gave his Real Estate to be divided among his Six Children, that none of the Children who are of Age incline to have it Settled on them, and that it is very unlikely any of the others when they come of Age, will desire said Estate may be Settled on them, that those who are now of Age want their parts of the Estate to enable them to begin in the World, and that it would be a great Damage to the whole of it should be sold separately. They therefore pray Liberty to sell the whole of said Real Estate and the Proceeds of the same equally to be divided among the heirs, according to the last Will and Testament of the deceased.

Voted that the Prayer of the Petition be granted, and that the Petitioners, Hannah Ware, and Pelethia Ware the Executors of the last Will and Testament of Beriah Ware deceased in their said Capacity, be and hereby are fully Authorized and impowered to make Sale of the Real Estate mentioned in said Petition, for the most it will fetch, and to Execute a good Deed or Deeds of Conveyance for the same, in Law, to the Purchaser, they observing the directions of the Law, for the Sale of Real Estate and giving Sufficient caution to the Judge of Probated for the County of Suffolk, that the money arising by the Sale thereof be divided Among the Legatees of the said Beriah, according to his las Will and Testament.
